1. Purpose of this List
This List identifies third parties used by 404 Branding s.r.o. in providing the 404 Emails service that may process personal data in connection with the provision of the Service.
The List distinguishes between subprocessors of Customer Data under the Data Processing Agreement (“DPA”) and other service providers that may, depending on the particular activity, act in another role under applicable data-protection law.
This List supplements the DPA between 404 Branding s.r.o. and the Customer.
Capitalised terms not defined in this List have the meanings given to them in the DPA.
2. Subprocessors of Customer Data
OVH HOSTING LIMITED
Contractual address: Block 3, Harcourt Centre, Harcourt Road, D02 A339 Dublin 2, Ireland
Registration number: 468585
Purpose of processing: Provision of cloud infrastructure for 404 Emails, including hosting of application and database infrastructure and storage of database backups.
Location of processing: The 404 Emails production application and database infrastructure is currently hosted in OVHcloud's Gravelines (GRA) data centre in France. Database backups are stored using OVHcloud object storage within the European Union.
Data protection: Processing is governed by the applicable OVHcloud contractual terms and data-protection documentation. OVHcloud may use its own subprocessors in providing its services in accordance with the applicable contractual terms and data-protection law.
Plus Five Five, Inc. (Resend)
Address: 2261 Market Street #5039, San Francisco, CA 94114, United States
Purpose of processing: Delivery of transactional and marketing emails and processing of information necessary for message delivery, delivery status, delivery-related events and webhooks.
Location of processing: United States and other locations used by Resend and its subprocessors.
International transfers: Resend uses applicable international-transfer mechanisms under its DPA, including the European Commission Standard Contractual Clauses where applicable.
3. Other Service Providers
Certain providers used by 404 Branding s.r.o. may, depending on the particular processing activity, act as independent controllers, processors, or in another role under applicable data-protection law. Such providers therefore are not necessarily subprocessors of Customer Data under the DPA in all circumstances.
Stripe
404 Emails uses Stripe for payment processing, subscription management and related billing functionality.
For a Stripe Account located outside North America and South America, Stripe's DPA is entered into with Stripe Payments Europe, Limited, Ireland.
Depending on the particular processing activity, Stripe may act as a processor or as an independent controller of personal data.
As an independent controller, Stripe may in particular determine the purposes and means of certain processing related to fraud prevention and detection, security, compliance with legal and regulatory obligations, and operation of payment infrastructure.
Stripe is therefore not generally characterised in this List solely as a subprocessor of Customer Data.
4. Downstream Subprocessors
Subprocessors identified in this List may use their own subprocessors in accordance with their contractual terms and applicable data-protection law.
Their current subprocessor lists may be published and updated directly by the relevant providers.
404 Branding s.r.o. does not treat every such downstream provider automatically as its own direct subprocessor.
5. Changes to Subprocessors
404 Branding s.r.o. may update this List from time to time when a subprocessor is added, replaced or otherwise changed.
The Customer will be informed of an intended addition or replacement of a subprocessor in accordance with the DPA, generally at least 14 calendar days in advance, except where an urgent change is required under the circumstances provided for in the DPA.
The Customer's right to object and the related procedure are governed by the DPA.
6. Currency of the List
This List reflects the providers used by 404 Emails as of the effective date stated above.
The current version of this List will be made available through the 404 Emails service.
